1. Acceptance of Terms

By accessing or purchasing from BigMoetsy ("we," "our," or "the Store"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform or make purchases.

These terms apply to all visitors, customers, and others who access or use BigMoetsy.

2. Use of the Platform

You agree to use BigMoetsy only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the platform for any illegal or unauthorized purpose
• Attempt to access systems or data you are not authorized to access
• Transmit any harmful, offensive, or disruptive content
• Engage in automated scraping, crawling, or data harvesting without written consent
• Impersonate another person or entity
• Submit false or misleading orders or customer information

We reserve the right to terminate access to any user who violates these terms.

3. Payment Terms

All prices are listed in US dollars (USD) and are subject to change without notice. You agree to pay the full amount shown at checkout, including any applicable taxes and shipping fees.

Payments are processed securely via Stripe. We do not store payment card information on our servers. By completing a purchase, you authorize us to charge the listed amount to your selected payment method.

If a payment is declined or reversed without valid reason, we reserve the right to cancel your order and suspend future orders.

4. Shipping & Delivery

We aim to ship all orders within 1–3 business days of payment confirmation. Estimated delivery times are provided at checkout but are not guaranteed — actual delivery times depend on the carrier and destination.

BigMoetsy is not responsible for delays caused by shipping carriers, customs, weather events, or other circumstances beyond our control.

Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier. If your package is lost or damaged in transit, contact us at bigmoetsyos@polsia.app and we will work with the carrier to resolve the issue.

We currently ship within the United States. International shipping availability may vary by product.

5. Returns & Refunds

Our full refund and return policy is available at bigmoetsyos.polsia.app/refund-policy. Key points:

• 30-day return window from date of delivery
• Items must be in original, unused condition
• Refunds issued within 5–7 business days of receiving the returned item
• Some items are non-refundable (custom, digital, final-sale)

6. Fraud & Abuse Policy

We use fraud detection tools to screen all orders. Indicators of fraud include but are not limited to:

• Mismatched billing and shipping addresses with no explanation
• High-value orders from new accounts with unverifiable payment methods
• Multiple orders to different addresses placed in rapid succession
• Use of known fraudulent email domains or disposable email addresses
• Disputed chargebacks with a history of abuse

We reserve the right to cancel any order we reasonably suspect to be fraudulent, without providing detailed justification. Affected customers may contact bigmoetsyos@polsia.app to appeal the decision.

7. Chargeback Policy

If you believe a charge is unauthorized or incorrect:

1. Contact us at bigmoetsyos@polsia.app with your order number
2. Allow 48 business hours for us to investigate
3. If unresolved, we will support your bank's dispute process fully

Filing a chargeback without first contacting BigMoetsy for a legitimate, resolvable issue may result in the order being marked as fraudulent, future orders being declined, and potential blacklisting from our platform. We cooperate fully with payment processors to contest fraudulent chargebacks.

8. Intellectual Property

All content on BigMoetsy — including text, images, product descriptions, logos, and design elements — is owned by or licensed to BigMoetsy and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this platform without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, BigMoetsy and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, loss of data, or loss of goodwill — arising from:

• Your use of or inability to use the platform
• Any products purchased through the platform
• Unauthorized access to or alteration of your transmissions or data
• Any content or conduct of any third party

Our total liability for any claim arising from your use of BigMoetsy is limited to the amount you paid for the specific product or service giving rise to the claim.

10. Disclaimer of Warranties

BigMoetsy is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or harmful components. Product descriptions are provided in good faith but may contain inaccuracies — we reserve the right to correct errors without notice.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of BigMoetsy shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or the courts of competent jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Material changes will be communicated via email or a notice on the platform.

Your continued use of BigMoetsy after any changes constitutes your acceptance of the revised Terms.
